2. Scope and Application
These Terms & Conditions of Sale apply to all orders placed on www.helyabougies.com. They govern the contractual relationship between HELYA, a sole trader selling beeswax candles, and any consumer customer within the meaning of the French Consumer Code.
Placing an order constitutes unconditional acceptance of these Terms & Conditions.
3. Products
Our candles are handcrafted in France from 100% natural beeswax, with no added fragrance.
Due to the natural properties of the material and the handcrafting process, candle colour may vary from the photographs shown on the website and from one delivery to another. Such variations do not constitute a defect and cannot justify refusal of delivery or a refund.
All products are subject to available stock.
4. Orders
Customers may place an order with or without creating an account.
Creating an account allows customers to track orders, manage personal data, and access purchase history.
Information provided at the time of ordering must be accurate. Helya reserves the right to cancel any order in the event of manifest non-compliance or abusive behaviour.
5. Liability
Helya's liability extends until the parcel is handed over to the carrier, at which point responsibility passes to the delivery service.
However, in the event of delay, loss or damage, Helya undertakes to do everything possible to assist the customer in their dealings with the carrier and to find an appropriate solution as quickly as possible.
Helya cannot be held liable for any indirect damages arising from the use of, or inability to access, the website, except in cases of proven fault attributable to the brand.
In the event of misuse of the website, including the posting of illegal, offensive, or non-compliant content, Helya reserves the right, at its sole discretion, to immediately suspend or delete the relevant user account, without notice or compensation.
This measure is intended to preserve the security, quality and compliance of the website and to protect the experience of all users.
6. Prices
Prices are shown in euros inclusive of all taxes (VAT not applicable – Article 293 B of the French General Tax Code).
Helya reserves the right to modify its prices at any time. Products are invoiced at the price in effect at the time the order is confirmed.
7. Payment
Payment is made exclusively online via the secure Stripe payment platform, accepting Visa, Mastercard, American Express, and other cards.
Payments are encrypted in accordance with current security standards. Helya never has access to the customer's bank details.
An order is considered final upon payment confirmation.
No other payment method (cheque, bank transfer, cash) is accepted.
8. Delivery
Products are delivered within metropolitan France within an estimated timeframe of 2 to 5 business days from order confirmation.
Delivery costs are indicated at the time of ordering.
Helya undertakes to deliver products within a maximum period of 30 days. In the event of delay, loss or damage, customers are invited to contact Helya at: contact@helyabougies.com
9. Right of Withdrawal
In accordance with French consumer law, customers have 14 days from receipt of their order to exercise their right of withdrawal, without having to provide a reason or incur any penalty.
To exercise this right, simply send an email to contact@helyabougies.com.
Products must be returned in their original condition and packaging to the following address:

Return shipping costs are the customer's responsibility. Refunds will be processed within a maximum of 14 days upon receipt of the returned products.
Personalised or opened products are not eligible for withdrawal.
10. Personal Data
Personal data is collected for the purpose of order management and customer service. It is processed in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679).
Data may be shared with the following service providers:

La Poste or any other carrier: parcel delivery
In accordance with Articles 15 to 22 of the GDPR, customers have the right to access, rectify, object to, erase and port their data.

11. Intellectual Property
All content on www.helyabougies.com (texts, images, logos, design, product names, photographs, etc.) is protected by French intellectual property law.
Any unauthorised reproduction, use or distribution is strictly prohibited.
12. Website Use – Prohibited Conduct
Users are prohibited from:

attempting to access the source code

using the website for unauthorised commercial purposes

engaging in fraudulent or abusive conduct
Any unlawful behaviour may result in the deletion of the user account and denial of access to the website, without notice or compensation. Helya reserves the right to pursue legal action.
In the interest of fairness and to ensure our products remain accessible to all, orders are limited to a maximum of 15 candles per basket.
Any resale of Helya products without prior written authorisation is strictly prohibited. Our creations are intended for personal use or as gifts, in keeping with the artisan and ethical spirit of the brand.
13. Limitation of Liability
Helya's liability extends until the parcel is handed over to the carrier.
Helya cannot be held liable for indirect damages arising from the use of, or inability to access, the website.
14. Retention of Title
Products remain the property of Helya until full payment has been received from the customer.
15. Mediation – Amicable Dispute Resolution
In accordance with French consumer law, every consumer has the right to use a consumer mediator free of charge.
Helya has not yet appointed a designated mediator. This information will be updated once a mediator has been appointed.

16. Governing Law – Jurisdiction
These Terms & Conditions are governed by French law.
In the event of a dispute that cannot be resolved amicably, the competent courts shall be those within the jurisdiction of Paris, unless otherwise required by mandatory law.

Helya reserves the right to amend these Terms & Conditions at any time to reflect changes to the website, the services offered, or applicable legal and regulatory requirements.
